SUBJECT: Late Filing and PASSPort Disclosure Exemption Provisions A.

Reason: The PPB is proposing amendments to remove the permissibility of late filing of PASSPort questionnaires in all cases except for emergency procurements. The late filing provision was relevant before electronic filing but is no longer useful. The PPB
is also proposing amendments to codify current practices regarding PASSPort questionnaire filing exemptions for governmental and quasi-governmental agencies and exemptions for portions of the PASSPort questionnaires when in the best interest of the City.

Before the Department of Buildings can issue a permit for the alteration or demolition of a multiple dwelling in certain areas designated in the Zoning Resolution, the owner must obtain a Certification of No Harassment from the Department of Housing Preservation and Development HPD stating that there has not been harassment of the buildings lawful occupants during a specified time period. Harassment is conduct by an owner that is intended to cause, or does cause, residents to leave or otherwise surrender any of their legal occupancy rights. It can include, but is not limited to, failure to provide essential services such as heat, water, gas, or electricity, illegally locking out building residents, starting frivolous lawsuits, and using threats or physical force.
